1. Agreement and eligibility
These Paid Beta Terms of Service (the “Terms”) are an agreement between Blue Cipher LLC, doing business as Blue Cipher (“Blue Cipher,” “we,” “us,” or “our”), and the firm or other business that subscribes to Pigeon (“Customer”). The person accepting these Terms represents that they are at least 18 years old and authorized to bind Customer. Pigeon is currently offered only to approved United States businesses and their authorized users.
2. Paid beta service
Pigeon is a business VoIP phone and call-workflow service. The paid beta may include unfinished features, operational limits, and changes made as the service is tested. Customer may use Pigeon only for its internal business operations and only through accounts and phone numbers approved or assigned by Blue Cipher.
Pigeon is not a law firm, does not provide legal advice, and is not a substitute for Customer's professional judgment or recordkeeping obligations.
3. Subscriptions, renewal, and payment
Solo is $50 per month or $480 per year for one seat, with no seat add-ons. Firm is $200 per month or $1,920 per year and includes 5 seats. Each Firm seat beyond those 5, up to 20 seats, is $35 per month or $336 per year. The plan, billing period, included seats, usage allowance, price, taxes, and any promotional terms shown at checkout are part of these Terms. Unless checkout says otherwise, subscriptions renew automatically for the same monthly or annual billing period until canceled.
Solo and Firm each include a 7-day free trial. A payment card is collected when checkout starts. The plan price is charged when the trial ends unless the subscription is canceled before then. Starting the trial is the successful start of the subscription.
Clerk manages Pigeon's subscription workflow and Stripe processes payments. Customer authorizes recurring charges to the payment method provided through that workflow. Blue Cipher does not receive or store full payment-card numbers. Customer is responsible for accurate billing information, applicable taxes, and charges authorized by its administrators.
If a renewal payment fails, Pigeon provides a seven-day grace period after the subscription becomes past due. Customer remains responsible for the unpaid amount and must correct the payment issue during that period. Calling access may be suspended when the grace period ends if the subscription has not returned to good standing.
4. Cancellation and refunds
A firm administrator may cancel through the Pigeon Admin billing controls or by contacting contact@bluecipherit.com. Cancellation stops future renewal and normally takes effect at the end of the current paid billing period. Except where required by law or expressly stated at checkout or in a written order, fees already paid are non-refundable and are not prorated.
Canceling a subscription does not itself delete Customer data. Account and firm deletion are governed by the Privacy Policy and the account-deletion process.
5. Seats and firm administration
Customer is responsible for its administrators, members, invitations, extensions, and access decisions. Solo includes one seat and does not offer seat add-ons. Firm includes 5 seats, and each additional seat through 20 seats is billed at the extra-seat price shown at checkout, which may be charged on a prorated basis during an active billing period. Removing a member does not delete historical firm records.
6. Beta usage allowances
Each plan includes the usage allowance shown at checkout or in the applicable order. During the closed beta, Blue Cipher intends to observe and report usage without charging usage overages or automatically cutting off calls solely because an allowance is exceeded. This beta waiver does not permit abusive, unlawful, or technically harmful use, and it may be changed for a future billing period after advance notice.
7. Phone numbers and routing
The first new US local firm number is included in the plan price. Pigeon covers that purchase. Porting an existing number and additional numbers are not included as unlimited free numbers. Phone numbers, extensions, caller ID, voicemail, and routing are subject to availability, provider requirements, and applicable law. Assignment of a number does not transfer ownership of that number. Blue Cipher may replace, reclaim, or reassign a number when required by law, a provider, nonpayment, misuse, or termination. Number transfer or portability is not guaranteed and, when supported, may require account verification, payment of outstanding amounts, and cooperation with the relevant carrier.
If Customer asks to transfer an eligible number while the account is active and in good standing, Blue Cipher will reasonably cooperate with a properly authorized port-out request. Customer must work with the receiving carrier, provide accurate authorization and account information, keep the number active until the transfer completes, and pay any carrier or third-party costs. Blue Cipher does not add a separate port-out fee during the paid beta. Port timing and success remain subject to carrier processes and cannot be guaranteed.
8. Acceptable use
Customer and its users must not use Pigeon to:
- violate any law, regulation, court order, or third-party right;
- harass, threaten, defraud, impersonate, or mislead another person;
- place unlawful robocalls, spoof caller identity, or evade consent requirements;
- record or monitor communications without every notice and consent required by law;
- interfere with the service, probe its security, or introduce malicious code;
- share credentials or give unauthorized people access to firm or client data; or
- resell or sublicense Pigeon without written permission.
Customer is responsible for its calling practices, professional obligations, client confidentiality, and the accuracy and legality of data it enters, imports, or sends through an integration.
9. Emergency calling
Pigeon is not a replacement for a mobile or landline telephone and must not be relied on to reach 911 or other emergency services. Calling depends on electrical power, a compatible device, network access, operating-system permissions, and third-party services. Keep another reliable method available for emergency calls.
10. Calls, voicemail, and integrations
Pigeon does not record answered two-party calls. An unanswered or rejected caller may leave a caller-only voicemail, which is handled and retained as described in the Privacy Policy. Optional integrations, including Clio Manage, are subject to their own terms and may become unavailable or change independently of Pigeon.
11. Customer data and privacy
Customer retains responsibility for its business records and decides which authorized users may access firm data. Blue Cipher processes personal information as described in the Privacy Policy. Customer represents that it has the rights and notices needed to provide data to Pigeon and authorize its processing, including data imported from contacts or connected services.
12. Availability and beta changes
The beta is provided without a service-level agreement. Calls may be delayed, degraded, interrupted, or unavailable because of device, network, carrier, platform, provider, maintenance, or beta software conditions. Blue Cipher may modify, limit, or discontinue a beta feature and will provide reasonable notice when practicable.
The paid beta does not include automatic uptime credits or an outage refund. Blue Cipher may issue a discretionary account credit after a material service outage, but any credit is a case-specific courtesy, is not cash, and does not create a service-level commitment.
13. Suspension and termination
Blue Cipher may suspend or limit access for nonpayment, security risk, suspected fraud, unlawful or harmful use, a material breach of these Terms, or a provider or legal requirement. Where practicable, Blue Cipher will give notice and an opportunity to cure. Serious security, fraud, legal, or network risks may require immediate action.
Either party may end the beta relationship in accordance with the cancellation terms above. Provisions that by their nature should survive—including payment obligations, acceptable-use responsibility, disclaimers, and limits of liability—will survive termination.
14. Beta disclaimer
To the maximum extent permitted by law, Pigeon is provided “as is” and “as available” during the beta. Blue Cipher disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. Blue Cipher does not warrant uninterrupted calling, delivery of every notification or voicemail, preservation of every integration, or error-free operation.
15. Limitation of liability
To the maximum extent permitted by law, neither Blue Cipher nor its service providers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, business opportunity, or data, arising from or related to Pigeon, even if advised that such damages were possible.
To the maximum extent permitted by law, Blue Cipher's total aggregate liability arising from or related to Pigeon or these Terms will not exceed the fees paid or payable by Customer for Pigeon during the 12 months immediately before the event giving rise to the claim. These limits do not apply to liability that applicable law does not permit the parties to exclude or limit.
16. Indemnification
Customer will defend, indemnify, and hold harmless Blue Cipher, its affiliates, and their personnel from third-party claims, damages, penalties, costs, and reasonable legal fees arising from Customer's or its users' calling practices, Customer data, violation of law or a third-party right, misuse of Pigeon, or material breach of these Terms. Blue Cipher will promptly notify Customer of a covered claim and provide reasonable cooperation at Customer's expense. Customer may not settle a claim in a way that admits fault by or imposes an obligation on Blue Cipher without Blue Cipher's written consent.
17. Governing law and disputes
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law rules. Before filing a lawsuit, each party will give written notice describing the dispute and allow 30 days for a good-faith attempt to resolve it. Any unresolved action must be brought in a state or federal court with jurisdiction over Bibb County, Alabama, and each party consents to that court's jurisdiction and venue. These Terms do not require arbitration.
18. Changes and contact
